DMCA / copyright policy

1. Designated agent

Kashi.mov respects the intellectual-property rights of others and complies with the Digital Millennium Copyright Act, 17 U.S.C. § 512. Notices of claimed infringement should be sent to our designated agent:

DMCA Agent
Jan Rothmann
Sebastian-Bach-Str. 18
31141 Hildesheim
Germany
E-mail: copyright@kashi.mov

The agent is also registered with the U.S. Copyright Office at dmca.copyright.gov.

2. How to submit a takedown notice

To be effective under the DMCA, your notice must be a written communication that includes:

  1. A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (e.g., title, ISRC, or a link to a reference recording).
  3. Identification of the allegedly infringing material and where it is located on Kashi.mov, with enough detail for us to find it — ideally the direct URL of a published render or the username of the uploader.
  4. Your contact information: name, address, phone number, and e-mail.
  5. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.

Incomplete notices may not result in action. We will respond to valid notices by removing or disabling access to the material and notifying the user who uploaded it.

3. Counter-notice

If your content was removed and you believe it was a mistake or misidentification, you may send a counter-notice to the same agent. Your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, phone number, and a statement that you consent to the jurisdiction of the federal court in the judicial district where your address is located (or, if outside the United States, the Southern District of New York), and that you will accept service of process from the person who filed the original notice.

4. Repeat infringer policy

We terminate accounts of users who are determined to be repeat infringers in appropriate circumstances. We may also suspend access immediately if we receive a credible notice identifying conduct that places Kashi.mov at material legal risk.

5. Misuse

Knowingly misrepresenting that material is infringing may subject you to liability under 17 U.S.C. § 512(f). If you are unsure whether your use is fair, consult a lawyer before submitting a notice.
